By purchasing from Stuart Macka Photography (“Company,” “we,” “us,” or “our”), you agree to the following legally binding terms and conditions regarding payments, access to digital downloads, and ownership rights, in accordance with Australian Consumer Law (ACL).

1. Payments & Order Processing

• Full payment is required before any digital product, including but not limited to photos, images, or other downloadable content (“Products”), is made available for download.

• Any pending, incomplete, or declined payments will result in the automatic cancellation of the order, and no download access will be granted.

• The Company reserves the right to refuse or cancel any order if fraud, unauthorised payment, or any suspicious activity is suspected.

2. Release of Digital Products

• Digital downloads will only be made available once full payment has been received and cleared.

• If a payment is later reversed, disputed, or charged back, your license to use the Product is immediately revoked, and access to the Product may be terminated without notice.

• Any attempt to access or use a Product before full payment is strictly prohibited and may result in legal action.

3. Consumer Rights & Refund Policy

• Under Australian Consumer Law, you are entitled to a refund, repair, or replacement if a Product is faulty, not as described, or does not perform as expected.

• However, change-of-mind refunds are not permitted for digital products.

• Once a digital Product has been accessed or made available for download, all sales are final, except where required by Australian Consumer Law.

• If you experience technical issues with your download, you must notify us within 10 days of purchase at stuartmackaphotography@gmail.com

4. Ownership & Usage Rights

• Until full payment is received, all Products remain the sole property of Stuart Macka Photography.

• Upon payment, you are granted a limited, non-exclusive, non-transferable license to use the Product for personal or business use as outlined in the purchase agreement.

• You may NOT:

• Resell, distribute, share, or transfer the Product to any third party.

• Modify, alter, or create derivative works from the Product without explicit written permission.

• Claim ownership or copyright of the Product.

• Any violation of these terms may result in legal action and the immediate revocation of your license to use the Product.

5. Chargebacks & Unauthorised Payments

• In the event of a chargeback or payment dispute, all rights to the Product are immediately revoked, and you are legally obligated to delete all copies of the Product.

• The Company reserves the right to take legal action and seek damages for unauthorised use of the Product following a chargeback.

6. Modifications to Terms

• We reserve the right to update, modify, or change these terms at any time. Continued use of our services after changes to these terms constitutes acceptance of the revised agreement.

7. Governing Law

• These Terms are governed by the laws of Australia and the relevant state or territory

• Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of that state or territory.

By completing a purchase, you acknowledge and agree to these terms in full. If you do not agree, do not proceed with the purchase.
